AMBITION AND WISHFUL THINKING: CONJOINED TWINS IN CIVIL LITIGATION

For many years I’ve mediated thousands of widely varied civil lawsuits.  No matter how diverse the subject matter, wrongful death, real estate, employment or contract, many cases have been fueled by an ambition that is often hard to distinguish from wishful thinking.  Although ambition is usually displayed by the amount of damages sought by plaintiffs and their attorneys, it also regularly appears in the attitude of defendants and their lawyers and insurance claims personnel for different reasons.

Choosing a Good Mediator

Over the last six months, we’ve had the opportunity to interview a dozen of our colleagues, mostly attorneys, all of whom have regularly hired mediators.  We thought we’d take the guesswork out of the mediator selections process and share some of our findings that were compiled from many hours of interviews.

It was astonishing how many P.R. people couldn’t write three good sentences that answered the question: Why do you think your nominee is a good lawyer? One reader said there was no such thing as a good lawyer! Without explanation, and without apology, some lawyers nominated themselves. Some lawyers didn’t have a link to their bios, and many failed to read the instructions! Imagine how they review complex contract negotiations. Ha! We did get some good submissions and found that there are indeed lawyers out there who are making the world a good place to live!  I hope you enjoy this round-up. Happy Law Day!

May 1st is Law Day

It was President Eisenhower who proclaimed May 1 to be Law Day in the United States. The observance of Law Day was later codified as Public Law 87-20 on April 7, 1961.  We think May 1 is a great day to say thanks to the lawyers who are doing good work. Throughout May, we will be sharing news stories about lawyers who are practicing Good Law and making a difference in the world.
